Compliance & Corporate Governance
Compliance & Corporate Governance has become a current issue following the accounting scandals of Enron and Ahold. It is a term used by organizations to indicate they operate in accordance with laws and regulations.
Since 2007 a large section of Dutch law has been replaced by the Financial Supervision Act. In this Act and the accompanying Order in Council, the role and area of expertise of compliance and the compliance officer are described in more detail. The AFM (Authority for Financial Markets) is responsible for Market Conduct supervision whilst the Nederlandsche Bank (Dutch Central Bank) will maintain prudential supervision.
Due to the American SOx legislation, the concept has been developed further and has gained more significance. Because of the current economic crisis and the accompanying demand for more transparency and a more responsible approach by the financial sector, the area of compliance and corporate governance will become increasingly important in the future.
